Trademark Prosecution

Protecting your brand, whether for products or services is an important priority for your business. A trademark is one of the most important intellectual property assets your business will ever own, since it distinguishes your company and its products or services from those of your competitors.  The attorneys at Willi Law Firm have extensive experience with trademark prosecution before the United States Patent and Trademark Office.

A “trademark” is a word, phrase, symbol or design, or a combination thereof, that identifies and distinguishes the source of the goods of one party from those of others.  A “service mark” is a word, phrase, symbol or design, or a combination thereof, that identifies and distinguishes the source of a service rather than goods.  The term “trademark” is often used to refer to both trademarks and service marks.  While your business may establish common law rights in a mark based on use of the mark in commerce without registration, owning a federal trademark registration on the Principal Register provides several important benefits, including:

  • Public notice of your claim of ownership of the mark;
  • A legal presumption of your ownership of the mark and your exclusive right to use the mark nationwide on or in connection with the goods/services listed in the registration;
  • The ability to bring an action concerning the mark in federal court;
  • The use of the U.S. registration as a basis to obtain registration in foreign countries;
  • The ability to record the U.S. registration with the U.S. Customs and Border Protection (CBP) Service to prevent importation of infringing foreign goods;
  • The right to use the federal registration symbol ®; and
  • Listing in the United States Patent and Trademark Office’s online databases.

Federal registration also allows you to use the ® (the circle-R) symbol.  Any time you claim common law rights in a trademark, you may use the ™ (trademark) or ℠ (service mark) symbol to alert the public to your claim, regardless of whether you have filed a federal trademark application.  However, you can only use the federal registration symbol ® after the United States Patent and Trademark Office has actually registered the trademark.  Following federal registration, you can use the ® symbol on or in connection with the goods and/or services listed in the registration and claim all the benefits of federal protection.

September 24, 2013 – U.S. Patent and Trademark Office Registers AQUALUX Trademark.  Willi Law Firm filed a trademark application on behalf of its Austin-based client, Getagadget, Inc.  The U.S. Patent and Trademark approved Willi Law Firm’s trademark application and registered the AQUALUX trademark mark on the Principal Register.

August 5, 2013 – U.S. Patent and Trademark Office Registers MOST WANTED MODELS Trademark.  Willi Law Firm filed a trademark application on behalf of its New York and Germany-based client, Global Model Management, LLC, who represents approximately 500 internationally-recognized and notable models under the MOST WANTED MODELS mark. The U.S. Patent and Trademark approved Willi Law Firm’s trademark application and registered Global Model Management’s MOST WANTED MODELS trademark on the Principal Register.

May 21, 2013 – U.S. Patent and Trademark Office Registers COLLEGE DOZEN Trademark.  Willi Law Firm filed a trademark application on behalf of its San Marcos-based client, Dozen City LLC, who operates under the COLLEGE DOZEN trademark.  The U.S. Patent and Trademark approved Willi Law Firm’s trademark application and registered Dozen City’s COLLEGE DOZEN trademark on the Principal Register.

April 30, 2013 – U.S. Patent and Trademark Office Registers GETAGADGET Logo.  Willi Law Firm filed a trademark application on behalf of its Austin-based client, Getagadget, Inc.  The U.S. Patent and Trademark approved Willi Law Firm’s trademark application and registered the GETAGADGET mark and design on the Principal Register.

January 22, 2013 – U.S. Patent and Trademark Office Registers MOSAIC WEIGHTED BLANKETS Logo.  Willi Law Firm filed a trademark application on behalf of its Austin-based client, Mosaic Weighted Blankets, LLC.  The U.S. Patent and Trademark approved Willi Law Firm’s trademark application and registered the MOSAIC WEIGHTED BLANKETS mark and design on the Principal Register.

January 15, 2013 – U.S. Patent and Trademark Office Registers MOSAIC WEIGHTED BLANKETS Trademark.  Willi Law Firm filed a trademark application on behalf of its Austin-based client, Mosaic Weighted Blankets, LLC.  The U.S. Patent and Trademark approved Willi Law Firm’s trademark application and registered the MOSAIC WEIGHTED BLANKETS trademark on the Principal Register.

April 30, 2013 – U.S. Patent and Trademark Office Registers GETAGADGET Trademark.  Willi Law Firm filed a trademark application on behalf of its Austin-based client, Getagadget, Inc.  The U.S. Patent and Trademark approved Willi Law Firm’s trademark application and registered the GETAGADGET trademark on the Principal Register.

February 19, 2013 – U.S. Patent and Trademark Office Registers TRICON Logos.  Willi Law Firm filed two trademark application on behalf of its Cedar Park-based client, Trident Concepts, LLC.  The U.S. Patent and Trademark approved Willi Law Firm’s trademark application and registered the TRICON mark and designs on the Principal Register.

January 29, 2013 – U.S. Patent and Trademark Office Registers TRICON FIT Logo.  Willi Law Firm filed a trademark application on behalf of its Cedar Park-based client, Trident Concepts, LLC.  The U.S. Patent and Trademark approved Willi Law Firm’s trademark application and registered the TRICON FIT mark and design on the Principal Register.

January 15, 2013 – U.S. Patent and Trademark Office Registers PARTY POPPER Trademark and THE PARTY POPPER Logo.  Willi Law Firm filed two trademark applications on behalf of its Austin-based client, Getagadget, Inc.  The U.S. Patent and Trademark approved Willi Law Firm’s trademark application and registered the PARTY POPPER trademark and THE PARTY POPPER mark and design on the Principal Register.

January 8, 2013 – U.S. Patent and Trademark Office Registers TRICON and TRICON FIT Trademarks.  Willi Law Firm filed two trademark application on behalf of its Cedar Park-based client, Trident Concepts, LLC.  The U.S. Patent and Trademark approved Willi Law Firm’s trademark application and registered the TRICON and TRICON FIT trademarks on the Principal Register.

July 3, 2012 – Texas Secretary of State Registers MOSAIC WEIGHTED BLANKETS Trademark.  Willi Law Firm filed a trademark application on behalf of its Austin-based client, Mosaic Weighted Blankets, LLC.  The Texas Secretary of State approved Willi Law Firm’s trademark application and registered the MOSAIC WEIGHTED BLANKETS trademark.

June 27, 2012 – Texas Secretary of State Registers MOSAIC WEIGHTED BLANKETS Logo.  Willi Law Firm filed a trademark application on behalf of its Austin-based client, Mosaic Weighted Blankets, LLC.  The Texas Secretary of State approved Willi Law Firm’s trademark application and registered the MOSAIC WEIGHTED BLANKETS mark and design.

April 17, 2012 – U.S. Patent and Trademark Office Registers TRIDENT ROOFING Logo.  Willi Law Firm filed a trademark application on behalf of its Plano-based client, Trident Roofing Company, LLC.  The U.S. Patent and Trademark approved Willi Law Firm’s trademark application and registered the TRIDENT ROOFING mark and design on the Principal Register.

March 6, 2012 – U.S. Patent and Trademark Office Registers PREMIERE HOT TUBS Trademark.  Willi Law Firm filed a trademark application on behalf of its Austin-based client, Premiere Hot Tubs, Inc.  The U.S. Patent and Trademark approved Willi Law Firm’s trademark application and registered the PREMIERE HOT TUBS trademark on the Supplemental Register.

September 19, 2011 – Texas Secretary of State Registers PREMIERE HOT TUBS Trademark and Logo and WE MAKE IT EASY FOR YOU TO RELAX Trademark.  Willi Law Firm filed a trademark application on behalf of its Austin-based client, Premiere Hot Tubs, Inc.  The Texas Secretary of State approved Willi Law Firm’s trademark application and registered the PREMIERE HOT TUBS trademark and design and and WE MAKE IT EASY FOR YOU TO RELAX trademark.

July 26, 2011 – U.S. Patent and Trademark Office Registers JOURNYX Trademark.  Willi Law Firm filed a trademark application on behalf of its Austin-based client, Journyx, Inc., who operates under the JOURNYX.  The U.S. Patent and Trademark approved Willi Law Firm’s trademark application and registered their JOURNYX trademark on the Principal Register.
